Privacy
Your privacy is our priority. The California Market Transformation Administrator, or CalMTA (also referred in this policy as “we”, “us”, or “our”), understands that information protection is important to you, especially in today’s online environment. With CalMTA’s Privacy Policy, we emphasize our commitment to privacy and let you know: (i) what personal information we collect about you through your use of our website and/or any other site that we link to; (ii) how we use your personal information, and (iii) that we use any personal information provided to us responsibly to provide you with the services you request. This Privacy Policy does not apply to personal information we obtain in our capacity as an employer.
Personal information, or personal data, means any information that identifies or can reasonably be used to identify a particular individual, such as name, email address, telephone number, address, date of birth, your company’s name and its type of business, and your title. Personal information or personal data does not include data that does not reasonably relate to a specific individual.
We will occasionally update this Privacy Policy to reflect changes in our practices and services. When we post changes to this Privacy Policy, we will revise the “last updated” date at the top of this Privacy Policy. We recommend that you check our Website from time to time for any changes in this Privacy Policy.
Information that You Provide on the Websites. We collect information that you choose to provide on the Websites. For example, we collect information from you when you fill out a form or enter information on our Website. We also collect information from you when you sign up for our newsletter, respond to a survey or marketing communication, visit the Website, or use certain other Website features.
Information Collected through our Use of Cookies and Other Technologies. We also automatically collect information when you use our Websites, such as through our use of cookies. CalMTA uses “cookies” to remember user preferences and to maximize the performance of our Website. This information may include your IP address, your browser type and language, access times, the content of any undeleted cookies that your browser previously accepted from CalMTA, and the referring website address. We may assign your computer one or more cookies to facilitate access to the Website and to personalize your online experience. Most browsers automatically accept cookies, but you can usually modify your browser setting to refuse cookies or to alert you when websites set or access cookies. If you disable or refuse cookies, some parts of the Websites may become inaccessible or not function properly.
We may use standard Internet technology, such as web beacons and other similar technologies, to track your use of our Website. We also may include web beacons in advertisements or promotional or other email messages, or to determine whether messages have been opened and acted upon. The information we obtain in this manner enables us to customize our online offerings to deliver targeted advertisements and to measure the overall effectiveness of our online advertising, content, programming, or other activities.
The Website may use Google Analytics, a web analysis service provided by Google, in order to better understand your use of our Websites and how we can improve them. Google Analytics collects information such as how often users visit a website, what pages you visit when you do so, and what other websites you used prior to coming to such website. Google Analytics collects only the IP address assigned to you on the date you visit a website, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with your Personal Information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit a website, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to the Websites is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. Google utilizes the data collected to track and examine the use of the Websites, to prepare reports on its activities and share them with other Google services. To more fully understand how Google may use the data it collects on the Websites, please review “How Google uses information from sites or apps that use our services” (located here).
Some areas of the Websites may contain electronic images known as web beacons (sometimes known as clear gifs) that allow us and our third-party providers to count users who have visited certain portions of the Websites.
Use and Sharing of Information. To the extent required by applicable law, we rely on the following legal bases of processing:
- Where we need to perform the contract we are about to enter into or have entered into with you;
- Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests; or
- Where we need to comply with a legal obligation.
We use your personal information to provide and improve our offerings. We use your personal information to build and maintain a relationship with you, to register you as a new customer, to process and deliver your order, and to manage our relationship with you. We use personal information to make suggestions and recommendations to you about goods or services that may be of interest to you.
You may receive marketing communications from us if you have requested information from us, or purchased products or services from us, and you have not opted out of receiving that marketing. In general, you can visit the Websites without telling us who you are or providing any personal information about yourself, except that we may automatically collect personal information as described in the “cookies” section above. In a few areas on the Website, we ask you to provide information to enable us to contact and communicate with you, and tailor the content we provide to you. It is completely optional for you to participate.
Additionally, we may retain and use personal information to respond to your questions or requests for information about or from us. We may also use personal information as necessary to ensure compliance with any of our policies and any applicable legal requirements.
We may aggregate your information, without identifying you personally, to obtain statistical and demographic background on users of the Websites.
Sharing of Your Personal Information
We will not sell your personal information, as defined under applicable law, to any outside organization. We engage third-party providers who may collect or receive your personal information on our behalf. Such third-party providers perform functions such as payment processing, operating and supporting the Website, analysing data, or performing marketing or consulting services. They are typically required to process your personal information for specified purposes and on our instructions and they are subject to a duty of confidentiality.
We may also share personal information according to your consent. We will get your express opt-in consent before we share your personal data with any third party for marketing purposes. We may enhance or merge your information collected on the Website with data from third parties for purposes of tailoring the information we communicate to you.
We may also disclose personal information, as well as information collected via cookies or web beacons as described above, in connection with law enforcement, fraud prevention, regulation, and other legal action, or if we reasonably believe it is necessary to do so to protect CalMTA, its stakeholders, or the public.
As we grow and develop our business, our corporate structure or organization might change, we may merge or otherwise combine with, or we or portions of our business might be acquired by, another company. In any such transactions, personal information generally is, and should be expected to be, one of the transferred business assets. Also, if any bankruptcy or reorganization proceeding is brought by or against us, your information may be considered a company asset that may be sold or transferred to third parties.
Opt-out & Unsubscribe. You can ask us to stop sending you marketing messages at any time by following the unsubscribe link contained in our marketing messages sent to you or other instructions in our marketing materials, or by contacting us in accordance with the “How To Contact CalMTA” section below.
Third-Party Sites. There may be links on the Website that would link you to third-party websites. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. These third-party websites may independently solicit and collect personal and non-identifying information from you and, in some instances, provide us with information about your activities on those sites. When you leave our Website, we encourage you to read the privacy policy of every website you visit.
Protect Your Information. The CalMTA is committed to securely using and storing the personal information that we collect and will take reasonable precautions to protect your personal information from loss, misuse, unauthorized access, alteration, or destruction. We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used, or accessed in an unauthorized way, altered, or disclosed. In addition, we typically limit access to your personal information to those employees, agents, contractors, and other third parties who have a business need to know.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
Data Retention. We will only retain your personal information for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements.
Visiting The Website From Outside The United States. If you are visiting the Website from outside of the United States, please be aware that our servers are either located in the United States or, if located in other countries, may be accessed from the United States. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country, but please be assured that we take steps to protect your privacy. By using any portion of the Website, you are consenting to the transfer of your personal data to our facilities in the United States and those third parties with whom we share it as described in this Privacy Policy.

We do not knowingly allow minors to use our Website. If you are a minor, please do not use our Websites or send us your information.
